A Federal High Court sitting in Kano, has given an order of interim injunction restraining the Nigeria Police Force, Nigeria Security And Civil Defence Corps, and the Department of State Service (DSS) from executing the orders contained in the new Kano Emirate Council Bill 2024, passed Thursday by the Kano State House of Assembly.
The court order has also suspended the implementation of the operation of the new legislation as it affects all offices, and institutions of the Emirate Council created pursuant to the provision of Kano State Emirate Council Law, 2019.
The presiding judge of the Court, A.M. Liman, gave order yesterday, after listening to an application brought by Aminu Babba Dan-Agundi, a titled holders in the emirate (Sarkin Dawakin Babba), against the Kano state government, and 7 others, including the IG OF Police, Nigeria Security and Civil Defence Corps, and DSS.
After listening to the Counsel to the Applicants, Ibrahim Aliyu Nassarawa Esq, Justice Liman, granted a leave that the Applicants in the issue be serve their concurrent as well as other court processes on all the respondents.
The court has ordered that all parties in the dispute should maintain status quo and assent of the bill pending the hearing of the fundamental right application in the application before the court, and that in view of the constitutional and jurisdictional issues apparent on the face of the application, parties shall address the court on next hearing which is fixed for June 3, 2024.
