MTN versus AGF’s matter Adjourned to March 26 2019

It will be recalled that MTN instituted two separate matters against the Attorney General of the Federation and Central Bank of Nigeria in September. The matter against the Central Bank of Nigeria has been amicably resolved while the one against the Attorney-General of the Federation is still in court.

The matter against the Attorney General is with regard to the demand from the office of the Attorney General of the Federation for the sums of N242,244,452,215.97 and $1,283,610,357.86 representing import duty, withholding tax and value added tax that should have been remitted to the purse of the Federal Government.

MTN instituted the action on the basis that the demand and actions of the AGF are illegal and unconstitutional as it amounts to usurpation of the powers and duties of the Federal Inland Revenue Service (FIRS), Nigeria Customs Service (NCS) and the Minister of Finance.

The matter was assigned to Justice Aneke of the Federal High Court, Ikoyi Judicial Division. The matter last came up on February 5, 2019 and same has been adjourned to March 26, 2019.
