The Senate President, Bukola Saraki has filed a further stay of execution against the Code of Conduct Tribunal (CCT), as regards his ongoing prosecution before the tribunal over charges bordering on assest declaration.
The embattled Senate President through his lawyer, Mahmud Magaji SAN, before the Court of Appeal in Abuja filed an application seeking for an indulgence of the court to grant it an accelerated hearing.
Saraki who is currently facing prosecution before the CCT had earlier approached a Federal High Court seeking for a stay of execution, and also at the appelate.
At the resumption of hearing at the court of appeal yesterday in Abuja, counsel to Saraki, Magaji Informed the panel of judges about the new set of applications stating that, the respondents refused service of the processes when it was served on them.
As such, the panel of Judges stood down the matter for parties to regularise service.
In its application filed on October 5, 2015, Saraki is seeking a further stay of procedings on the respondents (the Federal Republic of Nigeria and the Inspector General of Police), and the court’s indulgence for accelerated hearing.
Magaji said, the need for the new application for a further stay of proceedings againt the respondents was because, the original application had been overtaken by events.
The panel of Judges, having heard the submissions, ordered the respondent to file its counter affidavit before the close of court business onOctober 7, 2015, it thereafter adjourned the matter to October 8, 2015 for definite hearing.
