NLNG vs NIMASA: Appeal court nullifies $57million judgment awarded to NLNG

The Federal Court of Appeal seating in Lagos on Friday has set aside the $57 million judgement, which was awarded in favour of the Nigeria LNG Limited (NLNG) against the Nigerian Maritime Administration and Security Agency (NIMASA).

The Federal High Court had in October 2017 said that NLNG was right in its refusal to pay levies demanded by NIMASA and that all such payments already made by NLNG to NIMASA should be refunded.

Delivering the High Court judgement, Justice M.B Idris said NIMASA was wrong in blocking the NLNG from having to its Bonny terminal for the purpose of enforcing the payments against NLNG.

On the contrary, Justice Mohammed Lawal Garba of the Court of Appeal in Lagos, upheld NIMASA’s prayers by setting aside the High Court judgement on the ground that NIMASA was not given fair hearing during the court proceedings.

According to Justice Garba, the case should be retried before another Federal High Court Judge.
